After that I was told that a better qualified candidate had been selected. I believe it may have been the results of the tests that kept me from being hired. Are these tests still legal? With certain exceptions, employers can no longer use polygraph tests, voice-stress analysis and other electronic methods to screen prospective or current employees.
To fill the gap, employers are turning to integrity quizzes and graphology, or handwriting analysis. The honesty exams usually are not tricky, asking about theft or deception straight out. Many job applicants are surprisingly candid in admitting their wrongdoings it's amazing what people will blab on "impersonal" written tests. The handwriting analysts look at some 20 different cursive characteristics and predict honesty and industry, or lack of either. Experts say the exams and handwriting tests have a wide margin for error and should be used only to supplement interviews and background checks.
The use of either screening method may hit the same shredder visited by their electronic cousins as the debate rages over whether you can actually measure honesty and, if so, the validity of tests to do so. The House Education and Labor Committee, for instance, has asked the Office of Technology Assessment to look into the integrity tests and find out if they merit passing marks. Validity is the essence of the issue, says expert Rodney Lowman, Duke University psychologist and author of "PreEmployment Screening for Psychopathology: A Guide to Professional Practice" (published by Professional Resource Exchange). Even the widely used pre-employment screener, the Minnesota Multiphasic Personality Inventory (MMPI), offers Lowman pause. "This test has excellent scientific validity as a measure of psychological problems.
But as a useful measure for pre-employment screening, there is considerably less data. We need more research to validate measuring psychopathology against employment criteria." Beyond the fact that even the most widely accepted job test needs more study, Lowman notes that there is no conclusive evidence that testing positively for a mental problem will necessarily hinder a potential employee's job performance really. "In many studies, well over half the people who manifest problems on the MMPI or other measures seem to function acceptably on the job," the psychologist says. "Moreover, psychological problems are not something that occur and stay with a person forever. People okay today can get sick tomorrow, and vice versa people can adjust and get better." Lowman adds that not only is employer vigilance in monitoring testing validity required, but that a rejected candidate should have an appeal procedure.
That's a great idea, but with legal liability encircling employers like a noose, it's unlikely that an interviewer is admit that you were turned down because you tested out of the norm.
